Who Can Be a Maryland Resident Agent?
A Maryland resident agent is a person or business entity that has a physical address in the state. In nearly every other state, this role is referred to as a “registered agent,” but Maryland uses the term “resident agent” instead. You or one of your co-owners can serve as your own resident agent, you can designate a friend or family member for this role, you can hire a lawyer or accountant as your agent, or you can hire an online business services company to provide resident agent service.
No matter who you choose to be your resident agent, they need to be physically present at the address provided to the state during all standard business hours. This person or entity does not need to have any prior experience being a resident agent, but it’s wise to choose a resident agent who is familiar with the serious responsibilities that come with this role.
The state of Maryland has an age requirement of 18 or older to fill this role. According to the Maryland Attorney General’s office, these are the qualifications to serve as a resident agent in this state:
“A resident agent is a person or entity that is designated to accept service of process on behalf of the entity in the event of a lawsuit. The address of a Maryland resident agent must be an actual physical location and not a post office box. A corporation’s resident agent must be one of the following:
- An adult resident of Maryland
